I Can Work if I Have TPS, Right?

Absolutely. Indeed, this is one of the benefits of TPS. To put it simply, you can work if you have been granted TPS here in the United States. Now, to make sure that you’re eligible for this, you have to submit Form I-765 to request employment authorization, either after you apply for TPS or at the same time. This is another way that we can help our clients: by making sure that your documentation is filled out exactly when it should be and how it should be.

When I Apply for TPS, Is That “Seeking Asylum?”

No, it really isn’t. It’s natural that some make that connection, but they are by no means synonymous. To be clear, the eligibility for TPS is actually more selective, it’s more rare. For example, anyone can seek asylum in America, only those from certain countries can apply for TPS. One significant difference, however, is in the eventual outcome: you can seek permanent residency if you are granted asylum, whereas TPS doesn’t have that same end goal

If I Do Become a TPS Holder, Can I Apply for a Green Card?

If you’re in the United States on TPS, that doesn’t mean that, automatically, you’re able to apply for a green card. However, that doesn’t mean that it’s impossible for you to qualify for permanent residency in some other way. Indeed, that’s one more way that we can help. We can go through your options with you, helping you to find the right one to fit you.

So, How Long Does TPS Last?

The truth is that there is no set date for each country. It changes. The Secretary of Homeland Security makes the determination about when this status ends. It will be announced. We can work with you to make sure that you’ll be able to take advantage of the best options for you.
