A Brief Overview of the Process
The first step in this process is submitting a Form I-129F to the United States Citizenship and Immigration Services (USCIS). This form is essentially a request to the U.S. government that your fiancé be approved for a K-1 Visa, letting the government know that, as soon as they come to America, you’ll be married within 90 days.
What should be included with this form? Documentation. Evidence. You, as the petitioner, must do everything possible to make your case. That usually includes evidence of your U.S. citizenship, biographical details and anything else that can prove the legitimacy of your relationship with your fiancé. Optimistically, let’s say, you’re approved. Then, it’s time for consular processing. This stage involves your fiancé applying for their K-1 Visa at the U.S. consulate in their home country. An online nonimmigrant visa application (DS-160), will be filed through the U.S. Department of State.
Your fiancé will then be summoned for an interview where their relationship with you, intent to wed, and legitimacy of your relationship will be under assessment. Successful completion of these steps will reward your fiancé with their K-1 Visa, granting access into the United States with the intent of marrying.
Be Prepared for the Interview
Navigating the K-1 Visa interview could pose a challenge, especially if you’re unfamiliar with the process. We can prepare you so that you’ll be ready. Keep in mind: this interview is only to authenticate your relationship.
Come prepared. That doesn’t just mean come with the prep we’ll provide you, but that you come with all the necessary documents. This can and should include any proof substantiating the authenticity of your relationship. Additionally, it can include your DS-160 confirmation page, a valid passport, your birth certificate, a comprehensive medical report, your affidavit of support (Form I-134), standard passport style photographs, and much more.
As to the interview itself, it will likely consist of a series of questions designed to help the officer gauge your relationship. We’ll make sure you’re ready to discuss in great detail the history of your relationship, initial meeting, the period you have been engaged, what your future plans look like, and so forth.
